The Recording Notification Service (RNS), allows members of the public to receive an email alert, whenever a document is recorded at the Victoria County Clerk’s Office, that matches the name they have registered**.

 There are NO FEES! All you need is a valid email address.

Be advised, by statute, not all names appearing on a document are indexed.  We are required to index grantors and grantees.

ATTENTION ASSUMED NAME FILERS:

HB 3609 (effective September 1, 2019) amended Chapter 71 of the Texas Business & Commerce Code to eliminate the county-level filing requirement for a corporation, limited liability company, limited partnership, limited liability partnership or other foreign filing entity that conducts business under an assumed name.

If you are filing an assumed name under a business type listed above, you will need to file directly with the Texas Secretary of State.

Senate Bill 30

Discriminatory Provisions in Real Property Records

The Texas Legislature recently amended the Property Code to provide a streamlined procedure for addressing discriminatory provisions in real property records. Although state law already declared restrictions and provisions in real property records that prohibit the use, sale or transfer of real property to a person based on race, color, religion, or national origin to be void and unenforceable, Senate Bill 30, which took effect on September 1, 2021, establishes a process for a property owner, or another person that the owner authorizes, to request a judicial review of specific property records to determine whether they contain prohibited discriminatory provisions.

The bill sets out the contents of the documents required to be submitted to the court as well as a suggested format for the court’s findings and order. Under certain circumstances, the court may issue its determination without conducting a hearing. No filing fees may be charged under the statute.

History

The office of County Clerk has been in existence in Texas since 1836, superseding the “escribano” of Spanish-Mexican rule.

Texas Constitution, Section 20, Article 5 provides:
There shall be elected for each county, by qualified voters, a County Clerk, who shall hold office for four years, who shall be clerk of the County and Commissioners' Courts and recorder of the county, whose duties, perquisites and fees of office shall be prescribed by the Legislature and a vacancy in whose office shall be filled by County Commissioners' Court until next general election; provided that in counties having a population of less than 8,000 there may be an election of a single Clerk who shall perform the duties of District and County Clerks. The county clerk is the record keeper and Registrar for the county, Commissioners' Court, County Court and County Courts at Law.

Duties of the County Clerk include recording and filing instruments that prove ownership or interest in real property, instruments concerning the identity of persons and commercial activities; misdemeanor criminal cases; civil cases from $500 to $250,000, probate court; data collection for reporting to several state and local agencies including the County Auditor, County Treasurer, Bureau of Vital Statistics, Department of Public Safety, Attorney General, Supreme Court of Texas and Office of Court Administration.

Additional duties include: recording cattle brands, records management, filing retired Notary records, Clerk for Juvenile Board, and Clerk for the Commissioners' Court.
